Atualização do teto limite do financiamento não havia sido aplicada pela faculdade; 17 alunos conseguiram decisão favorável em ação coletiva

Dezessete estudantes que cursam medicina em uma faculdade particular de Minas Gerais conseguiram na Justiça o direito ao reajuste do teto limite do Fundo de Financiamento Estudantil (Fies).

No caso em questão, os alunos obtiveram, no início do curso, financiamento que correspondia a 79% da semestralidade, uma vez que o teto à época da contratação era de R$ 42.529,03 por semestre – R$ 7.088,17 para cada mês – enquanto o valor integral da mensalidade da instituição de ensino era de R$ 9 mil.

“O Fies tem um teto limite mensal que era de R$ 7,2 mil e foi reajustado para R$ 8,8 mil em julho de 2022 a partir de uma resolução do MEC. Após os alunos realizarem o aditamento do Fies, uma atualização semestral, os valores não foram reajustados para o novo teto”, afirma o advogado Lucas Macedo, do escritório Rodrigues e Aquino.

Em razão disso, 17 alunos do 2º período de medicina de uma faculdade particular de Paracatu (MG) decidiram recorrer à Justiça para obterem a atualização do novo limite máximo semestral, equivalente a R$ 52.800.

O escritório Rodrigues e Aquino, especialista em direito estudantil, ingressou com uma ação civil coletiva com pedido de tutela de urgência alegando violação ao princípio da isonomia, legalidade e razoabilidade em razão da não atualização do aditamento contratual com o novo teto fixado pelo governo federal.

“Conseguimos que esses alunos tivessem acesso ao novo limite máximo semestral previsto para o financiamento, com a consequente redução proporcional do valor da coparticipação paga por eles”, conclui Lucas.
