nnnnCarlos Eduardo Thompson Flores suspendeu a decisão do juiz Eduardo Appio, da 13ª Vara Federal de Curitiba
nnnnO desembargador Carlos Eduardo Thompson Flores, do Tribunal Regional Federal da 4ª Região (TRF-4), suspendeu a decisão do juiz Eduardo Appio, da 13ª Vara Federal de Curitiba, que anulou condenação de 14 anos de prisão imposta pelo ex-magistrado Sérgio Moro ao ex-governador do Rio Sérgio Cabral.
nnnnThompson Flores considerou que Appio descumpriu decisão anterior do TRF-4. Segundo o desembargador, a medida tem o intuito de “ordenar o curso do processo, tumultuado em virtude de ação ou omissão do julgador” – no caso, Appio.
nnnnA decisão que o juiz da Lava Jato descumpriu, segundo o desembargador da Corte regional, foi proferida em abril. Na ocasião, o TRF-4 mandou Appio analisar pedidos de suspeição contra ele formulados. Até avaliar tais solicitações, o juiz da 13ª Vara Federal de Curitiba teria de se abster de proferir decisões no bojo da Operação Lava Jato.
nnnnNo entanto, do dia 2 de maio, Appio anulou todas as decisões tomadas por Moro no processo em que Cabral foi acusado de receber propinas nas obras do Complexo Petroquímico do Rio.
nnnnSegundo Thompson Flores, no bojo de tal ação foi argumentada a suspeição de Appio – alegação de que um juiz não é imparcial para julgar o caso. A solicitação está pendente de análise desde o dia 8 de março.
nnnnAssim, a avaliação do desembargador é a de que o juiz de primeiro grau anulou atos do processo, mesmo com a proibição, imposta pelo TRF-4, para que Appio não desse novas decisões nos processos vinculados à Operação Lava Jato.
nnnn“Então, ao proferir a decisão combatida na data de 02/05/2023, quando pendente julgamento de mérito da Exceção de Suspeição, o Magistrado descumpriu decisão deste Tribunal. Ainda que possa discordar do teor do julgamento proferido (pelo TRF-4), ao magistrado incumbia dar-lhe cumprimento, notadamente à vista do seu trânsito em julgado. Não o fazendo, realizou ato processual de validade questionável”, anotou o desembargador.
