nnnnO presidente Lula (PT) preteriu o nome apoiado por seus defensores e escolheu para o TRE (Tribunal Regional Eleitoral) do Paraná um advogado que, em périplos por Brasília, acenou a políticos do PT com a possibilidade de votar contra o ex-juiz e senador Sergio Moro (União Brasil-PR) no processo que pode resultar na cassação do seu mandato.

nnnnAlém de correr por fora na disputa, Jacob tinha contra si críticas públicas que havia feito ao PT, incluindo insinuação de sabotagem no acidente aéreo que levou à morte o presidenciável Eduardo Campos (PSB), em 2014.
nnnnAlém de Jacob e Sabbaga, compunha também a lista tríplice submetida ao governo Lula o nome de Gustavo Kfouri, mas ele era carta fora do baralho por ser advogado do ex-deputado Fernando Francischini (União Brasil-PR) e preferido dos bolsonaristas.
nnnnAntes da decisão de Lula, Jacob fez um périplo por Brasília que incluiu encontro com assessores de ministros, com a presidente do PT, Gleisi Hoffmann (PR), com o líder do partido na Câmara, Zeca Dirceu (PR), e com o presidente da Comissão de Justiça da Câmara, Rui Falcão (PT-SP).
nnnnSeu nome também foi submetido a uma junta composta pelos titulares da Casa Civil, Rui Costa, Secretaria das Relações Institucionais, Alexandre Padilha, Justiça, Flávio Dino, e AGU (Advocacia-Geral da União), Jorge Messias.
nnnnNas conversas, se apresentou como um advogado sem vínculos políticos, garantista, legalista e atento ao direito.
nnnnDe acordo com relatos, quando perguntado diretamente sobre os pedidos de cassação do mandato de Moro, apresentados pelo PL e pelo PT, Jacob afirmava que, se houver comprovação de descumprimento da lei eleitoral, não deixará de votar pela afastamento do ex-juiz por causa de seu currículo, número de votos ou pressão da opinião pública.
nnnnEm conversas, Jacob chegou a se definir, entre os candidatos, como único capaz de encaminhar um voto divergente caso o relator do pedido de cassação de Moro vote pela improcedência da representação contra Moro.
nnnnSua movimentação ocorreu em meio a publicações do marido de Sabbaga, Sandro Rafael Bonatto, com fortes críticas a Lula e ao PT, incluindo a afirmação que o governo representa um retrocesso no país.
nnnnA Folha de S.Paulo procurou o novo integrante do TRE do Paraná, mas ele não quis se manifestar.

nnnnSegundo esses relatos, Jacob disse que o senador não teria por que se preocupar se estivesse tranquilo com as provas que estão sendo produzidas na análise da representação.
nnnnA fase atual é de produção de provas. Entre as acusações, está a de gastos acima dos limites estabelecidos pela lei eleitoral. Para a disputa pelo Senado do Paraná, o teto era de R$ 4,4 milhões. Moro declarou um gasto de R$ 5,2 milhões, segundo o site do TSE (Tribunal Superior Eleitoral).

nnnnA nomeação de Jacob aconteceu no momento em que se apostava na apresentação de um parecer pela improcedência da representação, sob a relatoria do desembargador Mário Helton Jorge.
