BRASÍLIA, DF (FOLHAPRESS) – Os Estados Unidos rejeitaram o pedido da China para participar em conjunto com o Brasil das consultas na OMC (Organização Mundial do Comércio). Na próxima sexta-feira (25), o governo de Luiz Inácio Lula da Silva (PT) questionará a gestão de Donald Trump sobre as tarifas impostas ao Brasil, que chegam a 37,5% para alguns setores.
A posição dos EUA já era esperada por autoridades brasileiras, que veem a reunião em Genebra, na Suíça, como protocolar e não têm expectativa de que seja encontrada uma solução para o conflito comercial. As consultas representam a primeira etapa do processo de solução de controvérsias da OMC.
Em documento enviado à OMC, os americanos disseram que a solicitação de consultas apresentada pelo Brasil “não diz respeito a quaisquer atos, políticas ou práticas da China, tampouco a quaisquer tarifas impostas a produtos originários da China.”
Os Estados Unidos disseram não considerar procedente a alegação da China sobre ter interesse comercial substancial nessas consultas. Portanto, recusaram o pedido de Pequim feito no dia 6 de agosto.
Pelas regras da OMC, os países envolvidos nas consultas -no caso, Brasil e EUA- precisariam autorizar a participação de um terceiro membro.
A gestão Lula protocolou a ação na organização internacional no dia 27 de julho. O principal argumento do governo brasileiro é que o tarifaço desrespeita normas da entidade e anula princípios que devem ser aplicados a todos os países, segundo as regras internacionais do comércio.
O Brasil contesta tanto uma sobretaxa de 25%, por supostas práticas comerciais injustas, como uma tarifa de 12,5%, aplicada com base em apuração sobre supostas falhas no combate à importação de produtos feitos com uso de trabalho forçado.
O pedido de consultas é a primeira etapa do processo na OMC. No Palácio do Planalto, recorrer à organização é visto como um gesto simbólico importante para marcar posição do Brasil em defesa do sistema multilateral de solução de disputas comerciais.
Se as consultas não resolverem a disputa, o demandante -no caso o Brasil- pode pedir a instauração de uma segunda etapa: um painel.
As partes formam os painéis com três membros, escolhidos em comum acordo. Os dois países apresentam petições escritas e participam de audiências. O painel emite um relatório sobre as medidas em contestação e sua compatibilidade com acordos da organização.
O prazo teórico para a apresentação desse relatório é de até seis meses, prorrogáveis por mais três. Na prática, a fase de painel tem durado cerca de 12 meses -a não ser em casos de maior complexidade, que podem se arrastar por até cinco anos.
Há possibilidade de recurso para o país derrotado, dando início a uma terceira e última etapa: uma contestação no Órgão de Apelação. O colegiado pode manter, modificar ou reverter as conclusões de um painel, e a decisão é de implementação obrigatória pelos países-membros. O problema é que essa última instância está paralisada desde 2019.
No ano passado, o Brasil protocolou na OMC uma primeira ação contra os EUA por causa do tarifaço de 40% aplicado sob a justificativa de que o ex-presidente Jair Bolsonaro (PL) estava submetido a uma “caça às bruxas”.
Cerca de duas semanas depois, o governo de Donald Trump aceitou o pedido de consultas feito pelo Brasil, mas afirmou que as queixas apresentadas pelo Itamaraty eram temas de segurança nacional e, portanto, não estavam sujeitas à revisão da entidade.
Essas tarifas foram declaradas ilegais pela Suprema Corte americana. Na ocasião, as delegações brasileira e americana na OMC chegaram a realizar reuniões sobre o tema.
