nnnn“Defiro o pedido de tutela antecipada para declarar nula a posse do cargo do atual presidente da Apex-Brasil, Sr. Jorge Ney Viana Macedo, por não ter demonstrado cumprir todos os requisitos mínimos exigidos no ato da posse, de acordo com o regimento jurídico vigente à época dos fatos”, diz trecho da decisão da 5ª Vara Federal Cível do Distrito Federal.
nnnnFoi determinada ainda a suspensão de mudança no estatuto social da agência, promovida após a chegada do petista, que revogou essa exigência para o ocupante do posto. Ele tomou posse no comando da agência que promove o país no exterior em 10 de janeiro.
nnnnProcurada pela reportagem, a Apex-Brasil afirmou que a AGU (Advocacia Geral da União), representante jurídica do governo, “ingressará em caráter de urgência” com recurso junto ao Tribunal Regional Federal da 1ª Região para tentar suspender a decisão liminar que anulou a posse de Viana.
nnnnA nota indica que a AGU também entende que os autores da demanda “desconsideram” que o estatuto da agência vigente à época da nomeação de Viana estabelecia como requisito para ocupação do cargo uma das três possibilidades: fluência ou nível avançado no idioma inglês, comprovados por certificado de proficiência ou certificado de conclusão de curso; experiência internacional (residência, trabalho ou estudo) por período mínimo de um ano, e experiência profissional no Brasil, de no mínimo dois anos, que tenha exigido o conhecimento e a utilização do idioma no desempenho das atribuições.
nnnn“Igualmente, os autores não atenderam a requisitos processuais essenciais à propositura da ação. Tampouco comprovaram o efetivo prejuízo causado pelo ato de nomeação”, complementa a nota.

nnnnNa esteira desse entendimento, concedeu ao ex-senador a recuperação de sua posse dentro de um prazo de até 45 dias, contado a partir do dia seguinte ao da decisão.
